WILL WRITING AND THE DANGERS OF DIY WILLS !

Today’s blog is about your last will and testament and the dangers of not arranging it with a legal specialist.

WILL WRITING AND GETTING IT RIGHT.

Have you ever heard of someone writing their wishes when they die on a piece of paper ?

Sadly without a legal will the law decides who gets what, not you, but despite this some people do decide to write their own, they may even buy a kit from a high street shop. They may feel delighted that they have spent £20 on something they feel will secure their entire estate for their loved ones. However it could in fact cost them a lot more later down the line when changes need to be made, or when your family need to go through probate after you have passed.

WHY WOULD YOU NOT SEEK PROFESSIONAL ADVICE TO AVOID MISTAKES ?

Not only that but when we all depart we also leave our loved ones in one of their most stressful and emotional times of their lives. They should be mourning and supporting each other and having to deal with your estate using a Will which is incorrect, or worse invalid, will be that last thing you would want for them.

The most common issue with a DIY Will is when it comes to witnessing the document. For a Will to be valid it must be signed by the person making the Will (the testator) and two independent adults. Neither of these witnesses can be beneficiaries or the spouses or civil partners of any of the beneficiaries. If the Will is not signed correctly, it is invalid, meaning your estate will pass in accordance with the laws of intestacy and most likely end up with your estate not being distributed, as per your wishes.

If you have any questions regarding your will please do let one of our specialist team know. We will gladly advise you or even invite you in for a free consultation with one of our Law Society regulated Will writing specialists.
